Public Rights of Way

Although many people enjoy walking, cycling and riding, the public rights of way network often causes problems for those whose land is affected.  We can advise clients on the duties, rights and responsibilities of all those involved with public rights of way either as users, landowners or statutory bodies.

The public rights of way network is made up of a large number of footpaths, bridleways and vehicular rights, many of which are of historical origin.  Changes to the network have to be made by formal orders which attempt to create, divert or extinguish public rights of way.  These orders are extremely technical and the order process can be very difficult.  We can act for you to promote or support such orders, or if you feel that such changes are not desirable, we can object on your behalf. back

Modification orders

The public rights of way network – footpaths, bridleways and other vehicular rights – has always been affected by informal changes.  These informal changes arise through public use and can lead to the creation of new rights and the diversion of existing rights.  In order to formally recognise these changes, modification orders are made by the local highways authority.  These modification orders can recognise historical changes of many years ago, or recognise changes happening today. 

In either case the modification order can have an immediate and drastic effect on the enjoyment and value of your property.  We can advise you on the impact of a proposed modification order and using our knowledge and experience we can object to the order on your behalf. back
